A shocking $175,000 bill has been slapped on a gym chain co-owned by former NRL star Beau Ryan, and the reason might surprise you!
In a recent court ruling, it was decided that playing music during fitness classes without the proper licensing can land you in hot water. And this is exactly what happened to the S1 Training gyms, which found themselves in a legal battle with the Australasian Performing Right Association (APRA).
But here's where it gets controversial...
APRA, the organization responsible for granting music licenses, took action against the gym chain for playing songs by artists like Avicii and Vengaboys without paying the necessary fees. The case revealed a hidden cost of doing business in the fitness industry, one that many might not be aware of.
The federal court found that the companies operating S1 Training gyms had infringed copyright by playing music during workouts between 2020 and 2024. This included popular tracks like "Horny 98' Radio Edit" by Mousse T. and "Wake Me Up" by Avicii.
APRA claimed they had reached out to the franchises and offered them a license, but the offer was declined. The organization further alleged that the gym's director, Kieran Turner, was aware of the legal requirements but took no action to stop the unlawful music performances.
Turner, on the other hand, argued that APRA couldn't prove ownership of the copyrights and that the undercover recordings were made illegally. He also stated that he didn't personally authorize the fitness trainers to play music and that it was the responsibility of each trainer contractor to obtain the necessary licenses.
However, the judge, Nicholas Manousaridis, found that the performance of music was an integral part of the S1 classes and that Turner would have been aware of this, given his involvement in setting up the sound equipment.
The court ordered the S1 branches to pay damages, including unpaid license fees, interest, and additional charges for each infringed track. The total amount came to $175,398, a significant cost for the gym chain.

S1 Training, registered as SWEAT 1000, was founded in 2020 by Turner, with Beau Ryan becoming an equity partner and ambassador in 2021. The company's ownership documents show Ryan's involvement, raising questions about the future of the business and its ability to recover from this legal setback.
Karen Holmes, director of APRA's OneMusic licensing organization, emphasized that seeking legal redress is a last resort, and they typically offer businesses the chance to obtain a license first.
